Online Gambling Ban May be Challenged in Court of Law by iMEGA

Interactive Media and Entertainment Gaming Association (iMEGA) has thus far been doing some of the most good for the U.S. facing online gambling industry. Taking measures to challenge the Unlawful Internet Gambling Enforcement Act in a court of law, iMEGA is now waiting for a decision by U.S. District Court (New Jersey) Judge Mary L. Cooper, on whether there are enough grounds to take the U.S. government to court, which U.S. legal representatives claim there are not.

Most of us can agree there is plenty enough basis for challenging the UIGEA, as well as having it overturned. Whether Judge Cooper sees the same picture will be known very soon. Judge Cooper has been deliberating for the past thirty days on whether to approve a motion to move the lawsuit forward. The court had said that she would have a decision within thirty days, although statutes say a Judge can take as long or as little time as they like in coming to a decision. Understandably, this is an important decision, and so nobody is breathing down Judge Cooper's back to make a decision.

An iMEGA representative said they believe Judge Cooper will make an official decision in the coming days. The fact that Judge Cooper has taken so long to deliberate the issue is seen as a good sign by many, because it shows that she does not consider the case a "nuisance lawsuit" - one which would have been immediately dismissed if it did not have any merit.

If the case is allowed to go to court, that would mean the UIGEA would be legally contested before a jury for the first time. Based on the grounds that 1) The UIGEA is a violation of one's civil rights, and 2) The UIGEA is a fundamentally poor law, the iMEGA has a strong chance at overturning the online casino gambling ban in the U.S. To take the words for Congressman Barney Frank, iMEGA will use their case to show that "The UIGEA is the stupidest law ever passed".
